Last updated: October 2026

1. Scope and Provider

These General Terms and Conditions apply to all services of KIAM Advisory, proprietor Emeline Sandrine Betsi Épse Kiam, Veilchenweg 10, 59192 Bergkamen.

KIAM Advisory offers in particular coaching, consulting, training, workshop and development services as well as programmes for leadership and personal development.

These GTC apply to consumers and entrepreneurs, unless deviating individual agreements have been made for the respective service.

Deviating terms and conditions of the customer shall only become part of the contract if KIAM Advisory expressly agrees to their validity.

2. Services

KIAM Advisory offers in particular the following services:

  • systemic business coaching

  • leadership and executive development

  • individual coaching and consulting services

  • HR consulting

  • workshops and trainings

  • multi-part development and training programmes

  • KIAMBETSI® programmes and related services

The type, scope, duration and specific content of the respective service result from the respective offer, the service description, the booking or the individual agreement.

KIAM Advisory determines the specific methodological and organisational implementation of the agreed service within the agreed scope of services.

3. Conclusion of Contract

A contract is concluded by the acceptance of an offer from KIAM Advisory or by a corresponding booking or commissioning by the customer and the subsequent confirmation by KIAM Advisory.

For services that can be booked online, the conclusion of the contract is governed by the respective booking process.

The prices, service content and special conditions applicable in each case are communicated to the customer prior to the conclusion of the contract in the form provided for this purpose.

4. Prices and Terms of Payment

All prices are stated in euros (EUR).

Insofar as value added tax is incurred by law, it is shown and charged in accordance with the statutory requirements.

Unless otherwise agreed in the respective offer or contract, invoices are due for payment without deduction within 14 days of the invoice date.

In the event of default in payment, the statutory provisions apply.

5. Appointment Cancellations and Cancellation Fee

For chargeable individual appointments, cancellation or rescheduling free of charge is possible up to 48 hours before the agreed appointment at the latest.

In the event of a later cancellation or non-attendance, a cancellation fee amounting to 50 % of the fee agreed for the respective appointment may be charged.

The customer expressly reserves the right to prove that no damage or significantly less damage has been incurred.

Free initial consultations, introductory meetings and other appointments expressly offered free of charge are excluded from this provision.

Statutory rights of the customer remain unaffected.

6. Performance of Coaching, Consulting and Training

Coaching, consulting and training services of KIAM Advisory are services.

KIAM Advisory owes the careful and professional provision of the respective agreed service, but not any particular personal, professional, economic or other success.

The customer bears responsibility for his or her own decisions as well as for their implementation and the resulting consequences.

Coaching and consulting do not replace medical, psychotherapeutic, legal, tax or other professionally reserved advice or treatment.

7. Customer's Obligations to Cooperate

The customer undertakes to provide the information, documents and details required for the performance of the agreed service in a timely and complete manner.

For services performed online, the customer is responsible for the necessary technical requirements on his or her side, in particular for a suitable internet connection and the use of the technical systems agreed for the performance.

Delays or additional effort resulting from missing or late cooperation by the customer may lead to an appropriate adjustment of the performance, insofar as this is necessary for the agreed service.

8. Corporate Assignments and Confidentiality in Coaching

If a coaching, consulting or development service is commissioned or paid for by a company for a specific person, personal content and confidential information from individual coaching or consulting sessions shall, as a matter of principle, remain confidential.

Such content shall only be disclosed to the client with the consent of the person concerned, on the basis of a legal obligation or insofar as this has been expressly and permissibly agreed for the specific contractually agreed service.

Organisational information about the implementation of a programme, for example attendance or agreed appointments, may be communicated to the client insofar as this is necessary for the performance of the assignment.

9. Confidentiality and Data Protection

KIAM Advisory treats confidential information that becomes known in the course of the collaboration as confidential and uses it only within the scope of the agreed service and the statutory provisions.

Personal data are processed in accordance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR).

Further information on the processing of personal data is contained in the privacy policy of KIAM Advisory.

10. Intellectual Property and Rights of Use

All concepts, methods, models, texts, presentations, working materials, documents and other content provided by KIAM Advisory remain, insofar as legally permissible, the intellectual property of KIAM Advisory or the respective rights holder.

This applies in particular to content, concepts and methods in connection with KIAMBETSI®.

The customer receives only the rights of use to the materials provided that are necessary for the agreed use.

Reproduction, publication, disclosure to third parties or commercial use is only permitted if this has been expressly agreed or is permitted by law.

11. Cancellation or Unavailability of KIAM Advisory

If an agreed appointment or an agreed service cannot be performed as agreed due to illness, force majeure or any other circumstance for which KIAM Advisory is not responsible, a substitute appointment or an alternative form of performance will be agreed where possible.

Payments already made will be credited against the substitute service.

Insofar as a substitute service is not possible or cannot reasonably be expected of the customer, payments for services not yet rendered will be refunded in accordance with the statutory provisions.

12. Term and Termination

In the case of individual appointments, the contract ends with the performance of the agreed appointment.

In the case of time-limited coaching, consulting, training or development programmes, the contract ends upon expiry of the agreed term or upon complete provision of the agreed services.

For longer-term contractual relationships, the respectively agreed termination conditions apply.

The right to extraordinary termination for good cause remains unaffected.

Statutory rights of the customer remain unaffected.

13. Right of Withdrawal for Consumers

Insofar as a consumer is entitled to a statutory right of withdrawal in a contract with KIAM Advisory, the statutory provisions apply.

The required cancellation policy and, where applicable, the model withdrawal form are made available to the consumer in accordance with the statutory requirements.

If a consumer expressly requests that a service be commenced before the expiry of an existing withdrawal period, the statutory requirements for commencement of the service before the expiry of the withdrawal period apply.

Insofar as provided for by law, the right of withdrawal may expire prematurely under the corresponding conditions.

The details result from the cancellation policy applicable to the specific service in each case.

14. Applicable Law

The law of the Federal Republic of Germany applies.

With respect to consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has his or her habitual residence.

The UN Convention on Contracts for the International Sale of Goods does not apply.

15. Place of Jurisdiction

With respect to consumers, the statutory rules on jurisdiction apply.

If the customer is an entrepreneur, a legal entity under public law or a special fund under public law, the place of jurisdiction is, insofar as legally permissible, the registered office of KIAM Advisory.

16. Consumer Dispute Resolution

KIAM Advisory does not participate in dispute resolution proceedings before a consumer arbitration board unless there is a legal obligation to do so.

Insofar as there is a statutory obligation to provide information on consumer dispute resolution, the corresponding information will be provided in the form prescribed by law.

17. Final Provisions

Should any provision of these General Terms and Conditions be or become invalid or unenforceable in whole or in part, the remaining provisions shall remain unaffected.

An invalid or unenforceable provision shall be replaced by the statutory provisions
